Balaram Das, AOR<br \/>\nMr. Dushyant Dave, Sr. Adv.<br \/>\nUPON hearing the counsel the Court made the following<br \/>\nO R D E R<br \/>\nThis Court has taken Suo Motu cognizance of the situation<br \/>\narising out of the challenge faced by the country on account of<br \/>\nCovid-19 Virus and resultant difficulties that may be faced by<br \/>\nlitigants across the country in filing their<br \/>\npetitions\/ applications\/ suits\/ appeals\/all other proceedings within<br \/>\nthe period of limitation prescribed under the general law of<br \/>\nlimitation or under Special Laws (both Central and\/or State).<\/p>\n<p>To obviate such difficulties and to ensure that<br \/>\nlawyers\/litigants do not have to come physically to file such<br \/>\nproceedings in respective Courts\/Tribunals across the country<br \/>\nincluding this Court, it is hereby ordered that a period of<br \/>\nlimitation in all such proceedings, irrespective of the limitation<br \/>\nprescribed under the general law or Special Laws whether condonable<br \/>\nor not shall stand extended w.e.f. 15th March 2020 till further<br \/>\norder\/s to be passed by this Court in present proceedings.<\/p>\n<p>We are exercising this power under Article 142 read with<br \/>\nArticle 141 of the Constitution of India and declare that this<br \/>\norder is a binding order within the meaning of Article 141 on all<br \/>\nCourts\/Tribunals and authorities.<br \/>\nThis order may be brought to the notice of all High Courts for<br \/>\nbeing communicated to all subordinate Courts\/Tribunals within their<br \/>\nrespective jurisdiction.<br \/>\nIssue notice to all the Registrars General of the High Courts,<br \/>\nreturnable in four weeks.<br \/>\n(SANJAY KUMAR-II) (MUKESH NASA) (INDU KUMARI POKHRIYAL)<br \/>\nASTT.
