S. Sayal, Vice President, Pune<\/strong><\/p>\n<p><em>We have assembled here today to bid farewell to Respected Vice President Syal Sir, on his retirement.<\/em><\/p>\n<p><em>Today is an important day in his career and Life when he is retiring after 24-25 years in the Tribunal.<\/em><\/p>\n<p><em>It\u2019s bag of mixed feelings, for professionals, feelings of sadness; we will be missing one more Good Member and Vice President of our Mother Institution but on other hand I am sure his family, will feel little relaxed and comfortable; when he will not to be going to Tribunal every day before 9.00 am and carry back burden on his shoulder and office tensions to home.<\/em><\/p>\n<p><em>Today onwards he will be starting his 3rd innings. After your illustrious and unblemished record as \u201cJudge\u201d (Member); who was quick and clear in his thinking, straight forward and not getting bogged down on whether the matter or issue is heavy or complex or who is representing for that matter !!<\/em><\/p>\n<p><em>\u00a0<\/em><em>Heartiest Congratulations on Successful career in the Tribunal !<\/em><\/p>\n<p><em>\u00a0<\/em><em>Another specialty of Syal Sir was delivering the decision in 1 or 2 days.\u00a0 It was very common, when we used to go and appear at Delhi and Pune, before we returned to Mumbai the next day, the order used \u00a0to be pronounced.<\/em><\/p>\n<p><em>\u00a0<\/em><em>We can truly call him \u201cKarma Yogi&#8221;, completely focused and dedicated to work.<\/em><\/p>\n<p><em>\u00a0<\/em><em>My memory goes back to various opportunities which I got to assist the Bench, headed by Syal Sir since 2008. \u00a0Sometimes it was on a regular bench or sometimes a Special Bench. \u00a0It made no difference for him, whether it was Corporate Tax issue or Transfer pricing issue or international Tax issue; \u00a0all were handled with ease, clarity and with the same degree of perfection.<\/em><\/p>\n<p><em>\u00a0<\/em><em>I remember my early days of appearing before Special Bench where he was on Bench.\u00a0 It was in 2008 the Special Bench was hearing the matter in case of \u00a0Prakash L Shah.\u00a0 I was in the Court listening to proceedings.\u00a0 As there was no intervention and as the petitioners counsel was not able to assist the Bench satisfactorily, suddenly from Hon\u2019ble Bench Syal Sir asked me \u201cwill you be able to assist the\u00a0\u00a0 \u00a0Bench?\u201d\u00a0 \u00a0That was a great opportunity and we could satisfactorily assist Special Bench and the decision\u00a0 was in favour of the Tax payer laying down certain important principles of Law on whether\u00a0 forex gain could be treated as profit derived decision.\u00a0 This was upheld by the Bombay High Court and the Supreme Court.<\/em><\/p>\n<p><em>Another incident I distinctly remember\u00a0 is when I was assisting Special Bench in 2009 in the case of Topman exports.\u00a0 Hearing went on for 6 days. On the last day, we asked by Hon\u2019ble bench whether we should submit a note\/ our submission? Prompt reply came from Syal Sir, dictation of 5 days is over, only that of last day is pending.<\/em><\/p>\n<p><em>It is truly admirable and testimony that many of the decisions rendered by him were upheld by the High Courts and the Supreme Court.<\/em><\/p>\n<p><em>When I have some doubt on any issue or need guidance\/ direction,\u00a0 I look to some of the decisions delivered by Syal Sir. Syal such as,<\/p>\n<ul>\n<li>Extraordinary judge<\/li>\n<li>Person of few words<\/li>\n<li>A person of integrity and knowledge<\/li>\n<li>Gems like Shri R S Syal deserves to be preserved<\/li>\n<li>Highest height of glory<\/li>\n<li>Delivered many landmark cases, which are affirmed by the High Court and Apex Court.<\/li>\n<\/ul>\n<p><strong>Shri G S Pannu, Hon\u2019ble Vice President, Delhi Zone<\/strong> shared his association with Shri R S Syal much before both joined ITAT and after joining the ITAT, he praised the various qualities of Shri R S Syal, Honourable Shri G S Pannu stated that Honourable Shri R.S. Sayl is a role model to the members of the ITAT off the Bench and from the Bench. He wished him a great future life.<\/p>\n<p>The family members of Shri R S Syal described him as a person of full compassion and a complete family man and also shared how much he loved his job and family.<\/p>\n<p>The Honourable Vice President Shri R S Syal addressed the gathering as under:<\/p>\n<p><em>The\u00a0Hon\u2019ble\u00a0President Justice Bhadang\u00a0Sir,\u00a0the\u00a0Hon\u2019ble\u00a0VPs, respected sisters, brothers, representatives from various bar associations, DRs, ladies and gentlemen.\u00a0<\/em><\/p>\n<p><em>A very good morning.<\/em><\/p>\n<p><em>Let me\u00a0confess\u00a0at the very outset.\u00a0God has been very kind to me by bestowing many virtues\u00a0in life, which I did not deserve. One such virtue given\u00a0was in\u00a0the year\u00a01999 when\u00a0I was thrown in the lap of the Tribunal.\u00a0Frankly, people like me wander here and there and no one even bothers to look at them.\u00a0From a non-entity,\u00a0all of a sudden,\u00a0I\u00a0came to be known as\u00a0an Accountant\u00a0Member of the tribunal.\u00a0Honestly, this Institution\u00a0has given me so much in life,\u00a0 which no words are\u00a0adequate\u00a0to describe.<\/em><\/p>\n<p><em>During the\u00a0stint\u00a0of 24-25 years,\u00a0I had the privilege of working under 11 Presidents. The arm of my Tribunal\u00a0clock,\u00a0which started under\u00a0the presidency of\u00a0late Sh. T.V.\u00a0Rajagopala\u00a0Rao\u00a0Sir, has done full circle and reached\u00a0the\u00a0Hon\u2019ble\u00a0Justice Sh.\u00a0Bhadang\u00a0Sir. I cannot thank\u00a0each one of them for extending\u00a0all the co-operation and accommodation\u00a0during their respective terms.\u00a0I will be failing in my duty if I do not acknowledge their magnanimity. I am happy to say that the\u00a0legacy\u00a0is continuing\u00a0with\u00a0full force\u00a0in\u00a0the current dispensation.\u00a0<\/em><\/p>\n<p><em>My first day on the Bench was with\u00a0Shri\u00a0M.K.\u00a0Chaturvedi\u00a0Sir, who guided a na\u00efve like me.\u00a0He\u00a0continues to be\u00a0one of\u00a0my role models.<\/em><\/p>\n<p><em>I have worked with numerous stalwart JMs and AMs. The\u00a0long\u00a0list is confined not only to my seniors but also\u00a0encompasses\u00a0my batch\u00a0mates and the\u00a0later\u00a0joiners.\u00a0It is an\u00a0uphill\u00a0task for me to name them in any order.\u00a0I am grateful to\u00a0each one\u00a0of them for\u00a0giving me guidance and cooperation.\u00a0<\/em><\/p>\n<p><em>Many good\u00a0words have\u00a0been spoken\u00a0about me\u00a0by the Bar representatives, DRs and my colleagues.\u00a0I am humbled by\u00a0these\u00a0and grateful\u00a0to all the speakers\u00a0from the core of my heart.\u00a0However, in my opinion, these\u00a0accolades\u00a0are unwarranted for a judicial officer, who\u00a0is supposed to do all that is officially expected of him. I just did what was\u00a0supposed to\u00a0be\u00a0done\u00a0and this doing is no reason to be applauded.\u00a0However, the undoubted takeaway is the immense job satisfaction, which I drove home daily. There was never even a single day when I did not love my work.<\/em><\/p>\n<p><em>Turning\u00a0to appreciating\u00a0a few\u00a0orders\u00a0by some\u00a0speakers, I say with full conviction that it is all the result of the arguments put in by both sides. I only became a medium to convey your arguments in my words.\u00a0Nothing more than that. Frankly, my endeavour has always been to\u00a0decide\u00a0the cases\u00a0to the best of my\u00a0ability\u00a0without any regard to\u00a0the amounts involved or the face value of the persons arguing.\u00a0During such a long period,\u00a0I\u00a0committed several\u00a0mistakes\u00a0while deciding matters. But it was never intentional. <\/em><\/p>\n<p><em>I am thankful\u00a0to the Registry\u00a0for\u00a0its continued support and cooperation. It has been my good\u00a0fortune to get good personal staff, including the\u00a0Sr\u00a0and Private Secretaries and the MTS\u00a0throughout\u00a0my tenure, who\u00a0are like\u00a0family. I take this opportunity to express my gratitude\u00a0to all of them.<\/em><\/p>\n<p><em>I express my gratefulness\u00a0to the\u00a0Pune\u00a0Income Tax\u00a0Tribunal\u00a0Bar Association, which made superb arrangements for this full court farewell.
