Dy.CIT ( Bang) (Trib) www.itatonline .org"},"content":{"rendered":"<div>\n<p><span lang=\"EN-US\">Pursuant to the original return filed on 28th Sept 2016 \u00a0for AY 2016-17 being found as defective, assessee filed corrected return on 23rd June 2017 and thereafter notice u\/s.142(1) after one year on 14th Aug 2018. Tribunal \u00a0\u00a0held that time limit for issuance of notice u\/s.143(2) ended on 30th Sept 2017[being 6 months from end of FY in which return is filed, thus the notice was issued beyond period of limitation; Relies on Gujarat High Court \u00a0decision in<\/span> Structures India Pvt. Ltd. v DCIT, reported in (2020) 113 Taxmann.com 577 (Guj) (HC) \u00a0<span lang=\"EN-US\">wherein it was held that upon such defects being removed, the return would relate back to the date of filing of the original return and accordingly, the limitation for issuance of notice u\/s.143(2) would be calculated; Thus, holds that \u201cthe impugned notice dated 14\/08\/2018 is issued beyond the period of limitation is quashed <\/span>and all proceedings taken pursuant thereto .<span lang=\"EN-US\">( <\/span><span lang=\"EN-US\">ITA No.1776\/Bang\/2019\u00a0 dt\u00a0\u00a0\u00a0 <\/span>16-09-2020 \u00a0<span lang=\"EN-US\">( AY. 2016-17 )<\/span><\/p>\n<\/div>\n<div>\n<p><span lang=\"EN-US\"><a href=\"https:\/\/itatonline.org\/digest\/wp-content\/uploads\/2020\/10\/Sindhu-Cargo-AY-2016-17-ITAT-Order.pdf\">https:\/\/itatonline.org\/digest\/wp-content\/uploads\/2020\/10\/Sindhu-Cargo-AY-2016-17-ITAT-Order.pdf<\/a><\/span><\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>S. 143(2) : Assessment \u2013 Notice \u2013  Beyond the period of limitation \u2013 Order passed is held to be bad in law .
