CIT (2024)462 ITR 141 (Delhi)(HC)"},"content":{"rendered":"<p>Allowing the petition the Court held that\u00a0 no recovery towards tax deducted at source could be made from the assessee in terms of the provisions of section\u00a0205\u00a0of the Income-tax Act, 1961.The Court also held that\u00a0 the assessee should be given credit for the tax deducted at source though it was not reflected in form 26AS. The assessee had followed the regime put in place in the Act for collecting tax albeit, through an agent of the Government. The agent for collecting the tax under the Act who was the deductor had failed to deposit the tax with the Government and the recovery proceedings could only be initiated against the deductor. The order passed under section\u00a0154\u00a0was accordingly set aside.
