Assessee filed her return of income for relevant assessment year declaring taxable income of certain amount. Thereafter, a notice under section 133(6) was issued to assessee seeking details with respect to purchase of an flat. \u00a0In response, assessee explained that she was a housewife and that purchase of said flat was done entirely by her husband from his own funds\/sources and not by her. She further stated that she had not contributed anything towards purchase of said flat and her name was added only for sake of convenience. She also produced purchase agreement as well as bank statement of her husband which indicated that entire consideration was paid by husband.\u00a0 Reopening notice was issued against assessee on ground that she had not disclosed correct income in her return. On writ allowing the petition the Court held that\u00a0 agreement for sale was duly stamped and registered and it was not in dispute that same was produced before Assessing Officer, bank statement of husband of assessee was also produced which showed that entire consideration paid for purchase of said flat was from funds of husband.
