ADIT(2026) 310 Taxman 97 (Mad)(HC)"},"content":{"rendered":"
Assessee-trust, claiming exemption under Section 11, was required to furnish Form 10B 30 days prior to filing the return. It filed the return on 15.02.2021\u00a0 and Form 10B on 16.02.2021, though the audit report was dated 15.10.2020, resulting in a delay of 32 days. Intimation under Section 143(1) was issued denying Section 11 benefit. Assessee filed application before CIT (E) under Section 119(2)(b) seeking condonation of delay. CIT (E) rejected the condonation request on the ground that the application was filed long after the Section 143(1) intimation. On writ, the Court held that the delay in furnishing Form 10B ought to be condoned and CIT (E)\u2019s refusal of condonation was not sustainable. Benefit of Section 11 could not be denied merely on the ground of procedural delay in filing Form 10B-Court imposed a token cost of Rs. 5,000, which was directed to be paid to the Tamil Nadu Advocates’ Clerk’s Association, High Court Buildings, High Court, Chennai-600 104.
