Assessee’s assessment was completed under section 143(3). Tribunal restored the matter to the Assessing Officer with a direction to exclude certain companies from the list of comparables. Assessing Officer did not pass any order giving effect to the Tribunal’s directions. The assessee filed a petition seeking refund on the ground that no effect order had been passed. Accordingly, the Single Judge allowed the writ and directed refund with applicable interest within a period of twelve weeks. Revenue contended that under pre-amended provisions of section 153 no period of limitation was prescribed for passing an order giving effect to order of Tribunal. Court held that a delay of about ten years could not be considered reasonable for passing an order giving effect to the Tribunal’s directions.
