correctness of the judgment of Hon'ble Apex Court in the case of Gold Coin

In the case of Gold Coin Hon'ble Apex Court has overruled the verdict of virtual soft system and held that pebnalty is leviable in loss cases. However no body has brought to the notice of Hon'ble Apex Court the decision of Constitutional Bench in the case of Varas International where it has been held that unless and until the retrospectivity is spelt out in the amended provision it can not be treated as retrospective
