{"id":14974,"date":"2020-05-18T11:49:31","date_gmt":"2020-05-18T06:19:31","guid":{"rendered":"https:\/\/itatonline.org\/info\/?p=14974"},"modified":"2020-05-18T11:49:31","modified_gmt":"2020-05-18T06:19:31","slug":"high-court-should-resume-normal-physical-hearings-as-democratic-functioning-is-imperiled-senior-advocates","status":"publish","type":"post","link":"https:\/\/itatonline.org\/info\/high-court-should-resume-normal-physical-hearings-as-democratic-functioning-is-imperiled-senior-advocates\/","title":{"rendered":"High Court Should Resume Normal Physical Hearings As &#8220;Democratic Functioning&#8221; Is &#8220;Imperiled&#8221;: Senior Advocates"},"content":{"rendered":"<p>Six eminent senior Advocates of the Bombay High Court, being Iqbal Chagla, Janak Dwarkadas, Fedun E De Vitre, Navroz Seervai, Darius Khambata and M P Bharucha, are planning to meet Chief Justice, Dipankar Datta to request that physical hearings with regular court working days and timings be resumed. <\/p>\n<p>Apparently, the request is motivated by the concern of the eminent counsel that &#8220;<em>democratic functioning<\/em>&#8221; has been \u201c<em>imperiled<\/em>\u201d by the present curtailed functioning of the Court. <\/p>\n<p>This was reported by the <a href=\"https:\/\/indianexpress.com\/article\/cities\/mumbai\/senior-lawyers-to-urge-bombay-hc-chief-justice-to-resume-physical-hearings-6415032\/\" rel=\"noopener noreferrer\" target=\"_blank\">Indian Express<\/a>. <\/p>\n<p>The legal fraternity is also concerned that the present system would lead to a huge backlog of cases. <\/p>\n<p>The senior lawyers want the court to hold hearings with full strength with all available judges on all regular court working day and make arrangements for the travel of all relevant staff as public transport remains suspended.<\/p>\n<p>Presently, the <a href=\"https:\/\/itatonline.org\/info\/imp-circular-of-bombay-high-court-reg-functioning-of-courts-during-covid-19-lock-down\/\">High Court is hearing only extremely urgent matters<\/a> through video conference until further orders in view of the extended lockdown. <\/p>\n<p>The court has also extended interim orders, which are in operation, passed by it, and subordinate courts in Maharashtra and Goa until June 15. <\/p>\n<p>The IE also reported that some senior lawyers had earlier requested the learned Chief Justice for a \u201c<em>hybrid<\/em>\u201d system with a mix of both video conferencing and physical hearings for those who could not access the virtual court.<\/p>\n<p>However, Video conferences, through which limited hearings take place now, are periodically disrupted due to connectivity issues.
