S. 68: Cash credits-Share capital and premium-Identity, genuineness of transaction and creditworthiness of investor were established -Addition deleted.

The assessee had received a certain amount on account of share capital, including share premium. The AO treated the aforesaid share capital as unexplained cash credit under section 68 and added it back to the total income of the assessee. On the revenue’s appeal, ITAT held that where identity, genuineness of transaction and creditworthiness of investor were unambiguously established by assessee in respect of share capital and premium raised by issue of preferential shares, CIT(A) had rightly deleted the addition.
