Affirming the order of the CIT(A) the Tribunal held that where order of Principal Commissioner passed under section 263 was quashed by Tribunal, and accordingly, further assessment order passed under section 143(3) read with section 263 giving effect to said order was also quashed, consequential levy of penalty under section 271(1)(c) which was based on said order passed under section 143(3) read with section 263 had no leg to stand.
