Dy. CIT v. Scicom Contact Centre Service (P.) Ltd. (2026) 310 Taxman 305 (Karn)(HC) Editorial : Oder of single judge, Scicom Contact Centre Service (P.) Ltd v.UOI (WP No. 4474/2024 dt. 21-8 2025 (Karn)(HC)

S. 153: Assessment-Reassessment-Limitation-Order giving effect to the order of the Tribunal-Assessing Officer failed to give effect to the Tribunal’s directions for ten years-Time granted by the Single Judge for refund was to be extended by another eight weeks.[S,143(3), 254(1), Art. 226]

Assessee’s assessment was completed under section 143(3). Tribunal restored the matter to the Assessing Officer with a direction to exclude certain companies from the list of comparables. Assessing Officer did not pass any order giving effect to the Tribunal’s directions. The assessee filed a petition seeking refund on the ground that no effect order had been passed. Accordingly, the Single Judge allowed the writ and directed refund with applicable interest within a period of twelve weeks. Revenue contended that under pre-amended provisions of section 153 no period of limitation was prescribed for passing an order giving effect to order of Tribunal. Court held that a delay of about ten years could not be considered reasonable for passing an order giving effect to the Tribunal’s directions. However, time granted by the Single Judge for refund was to be extended by another eight weeks. Appeal of revenue dismissed. (AY. 2005-06)
