Held that t he claims and contentions of the assessee both on legal as well factual aspects required verification by the authorities below. The matter is  remanded to the Commissioner (Appeals) to reconsider the contentions, claims as well evidence filed by the assessee, and to pass appellate order on the merits, both factual and legal, in accordance with law.
