Assessee, engaged in manufacturing and export of leather goods, filed its return claiming deduction under sections 80HHC and 80IB.Assessing Officer, while computing deduction under section 80HHC, first reduced claim under section 80IB from profits of business and thereafter allowed deduction under section 80HHC-It was noted that in case of Shital Fibers Ltd. v. CIT [2025] 306 Taxman 103/476 ITR 309 (SC), Supreme Court held that there was no requirement in section 80HHC to reduce deduction allowable under section 80-IA from profits and gains of business for computing deduction under section 80HHC. Tax demand was not based on proper computation of income, and hence, it was to be set aside, and the matter was to be remanded back to the Assessing Officer for computation of taxable income after giving due deductions under section 80IB and section 80HHC. Matter remanded. (AY. 2003-04)
