I have received from 3 from PCIT for VSV form filed for Appeal Case pending before CIT(A).
While filing form 4, Proof of withdrawal of Appeal is required to be filed with form 4, when appeal is pending before CIT(A).
No, as per Section 4(2) of VSVA, upon the filing the declaration, any appeal pending before the Commissioner (Appeals) shall be deemed to have been withdrawn from the date on which certificate is issued by the designated authority. After receipt of certificate one may have to intimate to the CIT (A) who will pass consequential order .
True, appeal is deemed to have been withdrawn but VSV Form 4 still requires proof of withdrawal to be attached and withdrawal reference no. to be filled in. What to do?

if appeal, writ petition slp etc. is pending before high court or supreme court or in arbitration then proof of withdrawn required is to be attached in form -4
What should be the proof of withdrawal of appeal which is required to be submitted with Form 4 under VSV.
Whether Form 3 received will do the needful?
Please login and go to e proceedings , there you will find a letter and you can give response thereby and attach soft copy of letter
I have checked Ma’am at e proceedings, but did not find any letter there.
I have received Form 3. Now how to file Form 4.

As appeal before CIT(A) is now faceless. There is no jurisdictional CIT now. Appeal has been filed but e preceeding has still not been initiated. There is no apparent procedure for the purposes of withdrawal. This seems to be an Anamoly . On e.nivaran no resolution has been suggested

Dear Madam, I have already paid fir VSW scheme but i am unable to fill form 4 as cannot withdraw appeal. There is no link on eproceedings. And enirvaan has not helped.
We can do following if appeal is fixed then make a online reply for withdrawal of appeal , and if appeal is not fixed then we can send a email to jurisdiction appeal authority and attached a copy of same with respose to form 3

In case your appeal is pending with CIT(A) and you have gone for DTVSV scheme and received Form 3. You can attach your DTVSV Form 3 along with an application for withdrawal of appeal in the e-proceeding tax where your appeal is pending for withdrawal of appeal. Further, you may also attach form 3 while filing form 4 as proof of withdrawal along with a letter dully signed. This is what i am doing.

Give an application to the office where your appeal is pending regarding the withdrawl of appeal.They will then give you the acknowledgement number which needs to be uploaded
