Kordient Ventures (P.) Ltd. v. Dy. CIT (2024) 297 Taxman 443 (Delhi)(HC)

S. 148A : Reassessment-Conducting inquiry, providing opportunity before issue of notice-Unexplained investments-Purchases reflected in GSTR-1-Failure to reconcile-Reassessment proceeding is valid. [S. 69, 148,148A(b), 148A(d), Art. 226]

On the basis of information reflected in GSTR-1 forms the reassessment notice was issued Said transaction stood. The asseee filed writ petition challenging the reassessment notice. Dismissing the petition the Court held that the assessee failed to provide purchase details, invoices, and bank statements, prompted Assessing Officer to conclude that certain sum had escaped taxation. Since assessee had failed to provide any plausible explanation for transaction which stood reflected in GSTR-1 forms and moreover, there was material to suggest that income had escaped assessment, Assessing Officer rightly initiated reassessment proceedings.
