Dismissing the appeal of the assessee the Court held that the authorities had not placed reliance or invoked S. 292C of the Act. Instead, on appreciation of the material keeping in view the entire facts and circumstances, they had concluded that there existed nexus between the assessee and the seized material. Therefore, since the assessee had failed to give any account for the unaccounted investment of Rs. 22,40,000, there was no illegality or perversity in the findings recorded by the Tribunal .Addition is held to be justified .
