sir, the finding of the high court is contradictory, one side it held that the imposition of the penalty is discretionary and also it says that reopening of the 158BC/BD assessment is not permissible. please comment.

there was addition u/s 40(a)(ia) now AO desires to impose concealment penalty. pl. guide on this point. as i have to reply to ao.
