The CBDT has issued Circular No. 3/2015 dated 12.02.2015 in which it has issued a clarification regarding the expression “amounts not deductible” under section 40(a)(i) of the Income-tax Act, 1961. The CBDT has referred to its earlier Instruction No. 02/2014 dated 26.02.2014 and clarified that for the purpose of making disallowance of “other sum chargeable” under section 40(a)(i) of the Act, the appropriate portion of the sum which is chargeable to tax under the Act shall form the basis of such disallowance and shall be the same as determined by the AO having jurisdiction for the purpose of section 195(1) of the Act

Vide Order dated 02.02.2015 passed by the Hon’ble President of the ITAT, Hon’ble Shri. G. D. Agrawal, Vice President of the Delhi Bench has been transferred in the same capacity to the Ahmedabad Bench. The CBEC has issued a sternly worded letter dated 20.01.2015 pointing out that the field formations are issuing summons to top senior officials in a routine manner to call for documents and enforce recovery of disputed dues. To prevent the abuse of this power, the CBEC has directed that the summons should not be issued except with the written approval of senior officials of the department. It has also been directed that senior executives should generally not be summoned in the first instance. It has been made clear that there should be strict compliance of the instructions and that non observance of the instructions will be viewed seriously.
