Pursuant to an order dated 17th May 2019 issued by the President, four Accountant Members and two Judicial Members have been transferred in public interest with effect from 31st May 2019

Pursuant to a resolution by the Standing Committee, the Assistant Registrar of the ITAT has issued an order dated 15th May 2019 stipulating the “Bench non-sitting days” in the ITAT. Different dates have been specified for different Benches.

The Appointments Committee of the Cabinet has approved the appointment of several candidates to the posts of Judicial Member and Technical Member in the National Company Law Tribunal (NCLT). Amongst the appointees are two serving Members of the ITAT. There are also several retired judges, Chartered Accountants and officials of the department in the list

ITAT being the Mother Tribunal, may impress other Tribunals to follow the good example set by ITAT. It is also desired that whenever a new Member is appointed,they may be provided the material which may contain code of ethics, guidance to be kept in view by the Members of the ITAT while drafting orders, conventions for Members of the ITAT etc

The CBDT has directed the formation of a committee consisting of high-ranking officials who will inter alia examine “perverse and irregular” orders of the ITAT and cases where the submissions of the DRs have not been recorded by the ITAT. These will be taken up by the CBDT with the President, ITAT/ Ministry of Law. The CBDT has also called for information relating to the performance of standing counsel as to the number of cases decided in favour of, and against, the department

There is no institutionalized process of elevation of the Members of the ITAT to the High Court. There are a good number of Judicial Members who deserve to be elevated to the High Court. AIFTP has made representation to Honourable Chief Justice of India and also to the Honorable law Minister. Hon’ble President, being from the judiciary, would be able to help in this regard and when the foundation day is celebrated the next year, some positive development could be expected

A full court farewell function was held to mark the retirement on superannuation of a Vice-President of the ITAT. The Hon’ble VP offered valuable advice including how professionals can stay healthy and wise with Yoga and the use of herbal medicine

It was earlier reported that 6 Accountant Members and 2 Judicial Members of the ITAT have been transferred with immediate effect. Now, the Hon’ble President has issued an order dated 5th December 2018 by which the transfer of an Accountant Member has been cancelled

The Office bearers had requested the Honourable President to visit the Library of the ITAT Bar Association.This suggestion received prompt attention and on 27-11-2018, the Honourable President along with the honourable Vice Presidents, Mr. G. D. Agarwal, Mr. Pramod Kumar and Mr. G. S. Pannu, visited the library and interacted with all the members present
