AIFTP Challenges Validity Of New Tribunal Rules In The Bombay High Court

A Writ Petition has been filed before the Hon’ble Bombay High Court by the All India Federation of Tax Practitioners (AIFTP) to challenge the constitutional validity of the Tribunal, Appellate Tribunal and other Authorities (Qualifications , Experience and other conditions of Service of Members) Rules, 2020.

The writ petition is expected to come up for hearing shortly.

As the issue is very important and will adversely affect the functioning of the ITAT and the appointment of Advocates and Chartered Accountants as Members of the ITAT, tax professionals and organizations across the country are also proposing to file similar petitions before the Hon’ble High Court of Madras, Rajasthan, Hyderabad, Delhi etc.
