Section 288 regulates the appearance by “authorized representatives” before any income-tax authority or the Appellate Tribunal. Sub-clause (viii) of the Explanation below s. 288(2), as amended by the Finance Act 2015, provides that a chartered accountant is eligible to be an “authorized representative” provided he is not “a person who, whether directly or indirectly, has business relationship with the assessee of such nature as may be prescribed”. The CBDT has now issued a Notification dated 24.06.2015 to insert Rule 51A and to define the nature of “business relationship” which is covered by sub-clause (viii) of Explanation below sub-section (2) of section 288 of the Act.

New ITAT Rules For Filing Appeals And Seeking Adjournment

We regret to announce that Hon’ble Shri. Vivek Varma, Judicial Member of the ITAT, passed away on 12th May 2015 after a prolonged illness. Shri. Verma was known for his calm and courteous demeanor. His 23 years experience at the Bar made him very understanding towards those who appeared before him. Though he joined this institution only 3 years ago, he has left a mark. He was one of the finest members of the Institution. His untimely demise is a colossal loss to the institution. He rendered several land mark judgments.

We are pleased to report that four members of the Tax Bar of Mumbai have been selected for appointment to the prestigious post of Hon’ble Members of the Income Tax Appellate Tribunal. While the members of the Bombay Tax Bar have always been forthcoming in answering the call of duty to the nation by joining judicial service, this is the first time that so many members have been selected together.

Vide Order dated 20th March 2015, the Hon’ble President of the Tribunal has directed that the order dated 2nd February 2015 is withdrawn forthwith and the practice of giving bonus point is restored. It is stated that the Vice Presidents will have the discretion to award bonus points in accordance with the quality and effort required to decide cases relating to International Taxation and Transfer Pricing
