Transfers Of ITAT Members (April 2018) (2)

The Hon’ble President of the ITAT has issued an order dated 20th April 2018 stating that the following two Members of the ITAT have been transferred:

(i) Shri Waseem Ahmed, Accountant Member, ITAT, Kolkata Benches has been transferred to ITAT Ahmedabad Benches with effect from 26 Apr 2018 (A/N)

(ii) Shri Narendra Kumar Billaiya, Accountant Member, ITAT, Ahmedabad Benches has been transferred to ITAT Delhi Benches with effect from 26 Apr 2018 (A/N).

Transfer Of ITAT Member (April 2018)

The Hon’ble President of the ITAT has issued an order dated 10th April 2018 stating that Shri Sabeer Singh Godara, Judicial Member, ITAT, Ahmedabad Benches, Ahmedabad, is transferred in the same capacity to ITAT, Kolkata Benches, Kolkata, in public interest, with effect from 23th April 2018 (F/N)

Farewell To ITAT Member On Retirement

A Full Court reference on the occasion of retirement of Hon’ble Shri. D T. Garasia, Judicial Member, was held on Thursday, 15th February 2018

ITAT & Other Tribunal Members To Be Appointed Only After “Character and Antecedents” Are Checked By Intelligence Bureau

The Government has issued a directive dated 8th January 2018 stating that the “character and antecedents” of candidates eligible for appointment to posts of Chairperson, President, Vice-Chairman, Accountant Member, Judicial Member, etc of the Tribunals and Regulatory bodies will have to be checked by the Intelligence Bureau before their names are recommended to the Appointments Committee of the Cabinet (ACC). It is warned that this instructions should be followed “without deviation

ITAT Gives Warm Send-Off To Retiring Vice-President

The ITAT arranged a tea party as well as a full court reference in honour of Shri P.K. Bansal, Vice-President, who attained superannuation on 9th January 2018. It is notable that Shri P.K. Bansal has qualifications in Law, Chartered Accountancy, Company Secretary and Management. He was a practicing Chartered Accountant for 20 years. The functions were attended by the Hon’ble President and Hon’ble Members of the ITAT as well as a large number of distinguished professionals

Transfers Of Hon’ble Members Of The ITAT (November 2017)

Vide order dated 16th November 2017 passed by the Hon’ble President pursuant to the consultations with the two senior most Vice Presidents, the following Members of the ITAT have been transferred in the same capacity to the respective Benches, in public interest, with effect from 1st December 2017

ITAT Judicial Member Appointed For Fixed Term Of Three Years After High Court’s Directive

Ms. Madhumita Roy had earlier been found ineligible by the ACC for appointment as a Member of the ITAT on the ground that she did not submit the income tax return for the year 2010-2011. The same was confirmed by the CAT. However, the Calcutta High Court held that this finding was erroneous. It directed the ACC to consider Ms. Madhumita Roy’s candidature afresh for appointment to the post of Judicial Member under unreserved category

Transfer Of Hon’ble Members Of The ITAT (August 2017)

Two Hon’ble Members of the ITAT, being a Judicial Member and an Accountant Member, have been transferred with effect from 16th August 2017 in public interest.

Ex Chief Justice & Eminent Legal Luminaries Slam Move By Govt To Curb Independence Of Tribunals

Hon’ble RM Lodha, the former Chief Justice of India, and other eminent legal luminaries, have voiced their opposition at the action of the Government in enacting the Tribunal Members Rules 2017. Under the said Rules, the Central Government has abrogated to itself the right to appoint, extend the tenure, and remove, the Hon’ble Members of the various Tribunals, including the ITAT. The luminaries are apprehensive that the appointments of Members of the Tribunal would no longer be impartial and independent and that the Hon’ble Members may be wary of taking bold decisions against the Government

Appointment Of ITAT Members For Only Five Years Will Undermine The Independence Of The ITAT: AIFTP

The All India Federation of Tax Practitioners (AIFTP), an apex body of tax practitioners, has addressed a detailed representation to Shri Arun Jaitley, the Union Finance Minister, pointing out that section 184 of the Finance Act 2017, which mandates the appointment of Members of the ITAT for a short tenure of only five years, will undermine the independence of the institution and lead to disastrous consequences. The AIFTP has warned that the whole purpose of setting up the ITAT as an independent and fearless judicial body will be frustrated and taxpayers will lose confidence in the institution. It has urged the Hon’ble Finance Minister to rescind the said provision and retain the existing provision for appointment of ITAT Members
