CBDT Reacts To High Court Strictures And Revises Guidelines For Appointment Of, And Fees Payable To, Standing Counsel

The CBDT has issued Instruction Nos.6 and 7 of 2016, both dated 7th September 2016, by which it has revised the guidelines for engagement of standing counsels to represent the income-tax department before the High Courts and other judicial forums. The CBDT has also revised the schedule of fees payable to the Counsel.

Prima facie, the CBDT appears to have borne in mind the strictures passed and directions issued by the Bombay High Court in CIT vs. TCL Holdings. The Court commented adversely on the “casual and careless representation” by the Standing Counsel even in cases having huge revenue implications.

    When they post you to these’coveted’posts they will justify all these posts carry special pay.In the other coveted posts they run the risk of being caught.
    The next reason is that the hard working people will create problems to them so ensure that they don’t come any where near those people who can bring them to face uncomfortable questions.
    There were a few who stood up and they become the beacon lights of the department.
    To take it to the next level of philosophy Christ was crucified !!!

    Only some are hard workers. Rest are churls.Inefficient. Corrupt. Ask and accept bribe. Strike deal with assessees. They feed their children with sucked blood.

      Yes, Ashwani, you are perfectly correct. Hard / honest /disciplined workers are punished, abused or side tracked. They are hoarded (posting them in H.Qrs), exported (sent on deputation or posted in ITAT/Audit/TDS) or melted (starting disciplinary proceedings). In Economics it is taught that BAD MONEY DRIVES GOOD MONEY OUT OF CIRCULATION. This I am writing with my personal experience with the Incometax Department.
