Imp Directives From ITAT Reg Hearing Of Stay Applications And Cases Involving International Tax And Transfer Pricing Issues

The ITAT Mumbai Bench has issued important directives regarding the hearing of stay applications and cases involving International Tax and Transfer Pricing issues

ORDER

It is hereby directed that, the Stay applications received by Wednesday upto 5.30 p.m. every week will be fixed on coming Friday in the same week. The Assistant Registrar, !TAT, Mumbai (Appeal) shall fix the said Stay Applications on
every Friday in the week.

However, in cases in which hearing of a Stay application is required on urgent basis, the assessee may make an application to that effect, showing clearly causes of such urgency, which will be placed before the undersigned for
appropriate orders.

There is an overlapping of jurisdiction of dedicated bench for international taxation cases, i.e. I bench, and dedicated benches for transfer pricing cases, i.e. J and K benches, in as much as some appeals involve transfer pricing as also international taxation issues. In this view of the matter, and with a view to evenly allocate workload in I, J and K benches, it is decided that all such cases, involving international taxation issues as also transfer pricing issues, will be heard by I bench.

In connection with the above, it is clarified that the appeals already scheduled for hearing before J and k benches in the current month may be heard by the respective benches, and, as such, the hearing of such appeals is not required to be adjourned only because these appeals also involve international taxation issues.
