Former Supreme Court Judge Levels Serious Allegation Of Corruption Against Chief Justice Of India

Justice Markandey Katju, the former judge of the Supreme Court, has levelled grave allegations in his recent blog post and also given particulars of alleged incidents.

In the past, Justice Katju has been in the news for the allegation that “50% of the higher judiciary has become corrupt”. He has also claimed that he had got a dossier on Chief Justice of India HL Dattu’s alleged properties and given it to then law minister Ravi Shankar Prasad and others, but to no avail. “I was targeted by former chief justice RM Lodha for my views. Let it all be investigated. SC judges are annoyed. But I am not bothered…,” Katju was reported to have said.

The learned former Judge has also levelled allegations against the Hon’ble Allahabad High Court (of which he was earlier acting Chief Justice) by asking whether “It is a High Court or a Joke?” At that stage also, a serious allegation was made that an adjourned matter does not come up for hearing unless a “heavy bribe” is paid to the concerned officials.

There has been another outburst from the learned former judge today. The provocation for the outburst is the recent judgement of the division bench of Chief Justice H L Dattu and Justice Arun Mishra in which the petition of Sanjiv Bhatt for constituting a special investigation team (SIT) and making BJP President Amit Shah and others parties to his petition. Justice Katju went to make the following allegation on twitter and in his blog:

What other verdict is to be expected from a bench presided over by that shameless man Dattu, who openly praised Modi, and against whom there are serious allegations of corruption?

In fact long before he was appointed Chief Justice of India I sent to the then Union Law Minister, Mr. Ravi Shanker Prasad, a copy of a dossier (I still have a copy with me) containing prima facie documentary proof of his massive corruption (I also gave copies of the dossier to Mr. Shanti Bhushan, senior member of the Committee on Judicial Accountability, media representatives etc). These include photocopies of a large number of sale deeds of plots of land in Bangalore in the name of his wife Gayathri (who must be privy to his prima facie corruption) showing her name but as daughter of K.G. Guruvayya, instead of wife of Dattu, and as an agriculturist. Why did the lady conceal her marital status?

Many of these plots were purchased in violation of the Karnatak Land Reforms Act.

Dattu got himself allotted one plot in a scheme in which Karnatak High Court employees alone could get a plot. A high court judge is not an employee. He got another plot in a scheme whose bye laws say that a person who or whose wife has a plot in Bangalore cannot be allotted a plot. A large number of other illegal acquisitions of wealth are mentioned in the dossier.

Dattu has built a palatial house in Bangalore on 1200 sq.m. land which must be costing 50 crores. Where did he get the money for this.

I requested all persons to whom I gave copies of the dossier that at least they should investigate the facts mentioned in the dossier, but nothing was done.

My guess is that when Ravi Shankar Prasad, the then Union Law Minister received the dossier I sent him, he must have shown it to Modi and Arun Jaitley, and then they must have blackmailed Dattu by showing him the dossier, and telling him to do as they say, otherwise they will expose him. How else is one to explain Dattu’s effulgent praise of Modi openly? And how else is one to explain this latest outrageous judgment?

The allegation was met with great shock and disbelief by Justice Katju’s followers on twitter and facebook.

    Only those who jeoparadise can understand this truth. Video recording should be must and within few days its copy should be given to respective parties, and see the SEA Change.

      where is the need for a video recording .The property is there for all to see and inquire .the investigative team can video record the house property and submit it to the appropriate agency which can then take cognisance of what was alleged

    As far as I recollect and think there are some people who want to stay in limelight. Now Mr Katju is again out with a out of pandora box new theleka. We should just let it go and thank our democracy that we have this kind of irresponsible people who say something and go scot free and give importance to the people of this ilk

    The rejection of Sanjiv Bhat’s petition bothered me too. But if a mangoman like me dared to comment thereon I sure would have been hauled for Contempt.

      Mr Katju is just trying to create a ruckus and has nothing material. Why is he writing in a blog there are so many offices where he could have gone. His comments are just wayward and stink of malice

        As a lay man all that i seek is an inquiry into the investment in a house property in bangalore . I do not think it is a herculean task to get this going. there after law can takes it course against datta or the complainant.Why discus things which are just bordering on speculative thinking.Just ascertain if the house property at bangalore is that of his family members.The law will take its course .

    Hon’ble Mr. Katju can himself investigate into the matter instead of just blaring his horns like Arvind kejriwal… Its one thing to make a random allegation but he must have documentary proof… Is he not aware of the RTI Act, guess he should use it before posting such blogs which undermine our judiciary in front of the whole world…He was the Acting CJ in the Allahabad High Court, why did he not make changes there… Constructive criticism is always welcome but not blatant allegations without proof

      In that case even Ajit Shah can also investigate.But investigation by a recognised body is acted upon.Well Katju could have done when he was acting CJ.But did he have the info with him that he has today.Today he is bringing in specific information . If that info is wrong let action be initiated against him.That is provided under law.

    What Mr. Katju has said may be correct but timing of bringing such vital infomation into public domain is questianable.

      Any response without being substantiated is equally irresponsible . At least Patel should say why it is questionable .Yes he is retiring in December 2015 and Katju has specifically mentioned the property in question.If that is found correct that is a good enough reason for initiating an action. It is a specific charge which can be enquired into within a short period f time.

    I also had a very sad experience when the case filed by me against a very large industrial house for share market related fraud was dismissed without even allowing me to present my case. The Bombay High Court Judge simply said – I cannot allow you. why have you traded in this share? When I asked for copy of the judgement, he wrote- ‘the Plaintiff prayed for liberty to withdraw the case and was allowed to withdraw’. I filed PRECIPE putting on record that the judgement was wrong and asked for corrected judgement, but to no avail.

    There is not an iota of doubt that there is rampant corruption in our system which is eating into the vitals of our society.
    However, does the solution lie in berating and undermining all public dealing institutions without any restraint or fetters or sense of responsibility.
    Whereas, we cannot and should not be silent spectators, yet we cannot foster a fatalistic attitude and pessimism in society by branding everybody corrupt and loudly saying so from the roof top.
    If we feel strongly about an ill or a wrong, there are civilised ways of seeking redressal rather than shooting letters or blogs in the public just because that’s the easiest route that simply requires tapping of fingers on a keyboard a few hundred times.
    There are hundreds and thousands of instance where our Courts have passed landmark judgements on complaints written by hapless citizens even on scraps of paper.
    Concerned citizens should form groups and approach the Courts or other administrative bodies and exert pressure in a systemic and responsible manner rather than make loose and casual remarks in public and weaken the already stressed institutions of our Country.

      Sir, Shri Ajay Wadhwa has given very reasonable views on the entire matter of corruption in higher echelons of judiciary ( or could be bureaucracy or politics). Problem is that many institutions such as CVC /CBI/ ED/ become slow when persons in power are to be investigated for corruption etc ( caged parrots?) but very quick against others. In my humble view , we should have the Lokpal in place very quickly to verify allegations against anyone ( in or out of power) without fear or favour so that public confidence in institutions is restored.

    Mr. Katju’s allegation against Honourable Chief Justice of India should be duly enquired. If the allegation is baseless and falls, appropriate action should be taken against Mr. Katju.

      Fair enough .But he has to step down if prima facie information furnished is correct like the property in Bangalore worth 50 crores is correct that cannot be hidden any where .It is there for all to see . I know of cases where judges did influence officers to get things toned down(documentary evidence)to ensure that they are not indicted

      There are lot of cases when the image of judiciary has got tarnished. It still remains in our mind afresh, the black mark in the Pride of our Judiciary when a Supreme Court Judge writing a judgement in favour of Top Political Brass getting Governor post immediately after his retirement .

    When Honorable Justice Katju was in possession of information why did he not file any complaint with concerned authorities and what was the reason that he chose to send that piece of information to the then Law Minister only when he is in practice of going to media for every small issue. The investigation must be done that why did he keep the information with him when the nature of issue was so serious and why did he choose this opportunity to raise the matter. Is he directly or indirectly connected with the people or institutions behind PIL/legal cases related to gujarat matters? He must answer these queries.

    • Evidences given by Mr Markandey Katju be used by CVC as they do not seem to have been used by BJP Minister and BJP PM and CVC should himself investigate highly serious allegations against CJI HL Dattu to retire on 2nd December 2015.

      Does thagt shows Indian Judiciary is a mockery?
      The number of cases pending hearing and disposal in Supreme Court, various High Courts and lower courts shows that there is no concern to the difficulties of ordinary citizens in the eye of Judges, Government and Beurocracy.

      What is wrong in sending it to the law minister .If he had gone to the media one would say he had other forums to vent his information.The Law minister was the right person to approach .One cannot find fault with the action.If the law minister has kept that in cold storage it is for him to respond.Just like in USA make a public person a lesson for probity and one can se others falling in line.It is high time that such actions are taken up in right earnest and the end brought to a quick end .There lies the issue .

    He( Mr. Katju) is a mental case, he can say anything to anyone, he is eating beef he is saying that Subhash Chandar Bose was a Japnese agent. I think his is from the same clan as that of AK 47

      Any one saying such things may sound to be a mental case. But before you write him off as a mental case verify the facts.what is mentioned by him are verifiable facts.It is in the public domain.

    No doubt several ministers, bureaucrat and High jurists have created huge land and buildings in different areas of the country cost of which comes to Rs in crores. Where did he get the money for this is a question for consideration to curb over corruption……….
